A chieftain of the African Democratic Congress (ADC), Usman Austin, has urged the Independent Corrupt Practices and Other Related Offences Commission (ICPC) to either formally charge former Kaduna State Governor, Nasir El-Rufai, to court or release him without delay.
In a statement issued on Saturday, Austin raised concerns over El-Rufai’s continued detention, stressing the importance of due process, transparency, and strict adherence to the rule of law in anti-corruption investigations.
ADC Demands Respect for Rule of Law
Austin referenced the approach of the Department of State Services (DSS), noting that the agency had recently sought judicial intervention in handling sensitive matters instead of resorting to arbitrary detention.
According to him, allowing courts to decide cases through merit-based arguments from both the prosecution and defence reflects democratic values and strengthens Nigeria’s justice system.
“If there are allegations against El-Rufai, they should be addressed in court. Arresting someone before commencing an investigation undermines the right to a fair hearing,” Austin said.
Uncertainty Over EFCC and ICPC Custody
The ADC chieftain also questioned the circumstances surrounding El-Rufai’s custody. He noted that the former governor had previously honoured an invitation by the Economic and Financial Crimes Commission (EFCC) and was reportedly cooperative with investigators.
Austin asked whether El-Rufai was officially transferred to the ICPC after being released by the EFCC or re-arrested after administrative bail, arguing that the lack of clarity weakens public confidence in anti-graft agencies.
PUNCH Online reported that El-Rufai was taken into custody by ICPC operatives shortly after his release from the EFCC, where he had been held for questioning since Monday.
The ICPC confirmed in a statement signed by its Head of Media and Public Communications, John Odey, that the former governor remains in custody as of February 18, 2026, in connection with an ongoing investigation.
