National News – The Nigerian Bar Association has cautioned courts and legal practitioners against interfering in internal political party disputes ahead of Nigeria’s 2027 general elections.
The warning was issued on April 10, 2026, in Abuja by NBA President Afam Osigwe, who raised concerns over increasing litigation drawing the judiciary into party matters.
The association stressed that such actions could undermine democracy, weaken party structures, and distort electoral processes if not urgently addressed.
The NBA explained that Section 83 of the Electoral Act 2022 clearly restricts courts from entertaining cases involving internal party affairs.
It also prohibits judges from granting interim or interlocutory injunctions in such disputes.
However, the association noted that despite these provisions, some courts continue to hear these cases and issue orders affecting party leadership and governance.
This, the NBA said, contradicts the law and risks politicising the judiciary.
According to the statement, some lawyers are fueling the trend through forum shopping and filing what it described as mala fide applications to secure favourable rulings.
The NBA warned that using the courts as tools for political advantage threatens the rule of law and could erode public trust in democratic institutions.
The association further emphasised that lawyers must uphold professional ethics and avoid acting as agents of political interests.
It warned that any legal practitioner found violating these rules could face disciplinary action, including referral to the Legal Practitioners Disciplinary Committee.
The NBA also urged the judiciary to exercise restraint and avoid being drawn into politically motivated cases.
It called on the National Judicial Council to sanction judges who assume jurisdiction in prohibited matters or grant orders contrary to statutory provisions.
Additionally, the association advised the Independent National Electoral Commission to remain neutral and avoid actions that could be perceived as political interference.
It reaffirmed its commitment to safeguarding the integrity of Nigeria’s legal system and democratic process.
